Rights management are at the core of fundamental disputes that have a wide ranging effect across the market landscape, from the creators of content all the way to the consumers. Some of the key issues have been addressed by FTI and translated into economic modeling that deliver urgent answers:
DRM and Interoperability Issues:
One of the hot-topic issues addresses the lack of interoperability of the various DRMs cluttering the marketplace and confusing consumers. Would digital music and video sales would be greater under an interoperable DRM than they would be otherwise? We have worked through the modeling approach with these experts, and have established two foundational precepts for this study. First, we do believe it is
decidable,
that is, we can answer this question with confidence and finality. Second, we believe the revenue potential of the market under an open DRM is a necessary first question but is not sufficient to decide the final value to the market of an open DRM. It turns out that
how
the industry achieves this openness can have a profound effect on the economic conclusions of the model – that is, the cost of achieving the openness may be greater than the associated revenue gains.
Reporting Issues:
As the music industry is discovering, digital operations have significant scaling issues: the proliferation of online retailers and revenue models such as download to own, to rent, subscription models and advertising models make the accounting (and rights settlement) much more complex. We can help distributors negotiate and design data feeds from online retailers that can be ingested easily by your IT departments, and contract pricing mechanisms with retailers that keep the accounting simple so that digital revenue can be scaled up in ways that don’t require undo incremental head count to administer. This is going to be essential as the digital retailer landscape is also about to increase domestically and internationally.
Sales Strategy Issues:
FTI proposes to build dynamic sales strategy and models of your portfolio of content designed with capabilities that will allow you to run sensitivity analysis based on changes in the following factors such as the length of the window in film and television, cannibalization risks in the development of distribution channels and potential bundling opportunities for all types of content.
